Terms and Conditions

 

 

1.     General Information

 

a.     By participating in this auction, you agree to the following terms and conditions. These terms constitute a legally binding contract between you (the bidder) and Go Bids Auction Inc. Please read them carefully before registering and bidding. Note that while these terms provide general information for auction listings, specific terms may apply. We make every effort to outline any special terms in an information lot at the beginning of the auction catalog.

b.     A 15% buyer’s premium applies to all purchases.

c.     Each auction company has its unique terms and conditions.

d.     All items are sold as is and where is. No refunds, and we do not provide any expressed or implied guarantees.

e.     Gobid Auctions, Inc. assumes no responsibility for loss, theft, or damage. All sales are final, and refunds are strictly not provided.

f.      We recommend that everyone previews all items at the specified time and date.

g.     Please ensure that you collect all items promptly at the specified time for each auction.

h.     Full payment for your purchases and fees is required before receiving your item(s).

i.       Failure to pay and collect your items will result in your bidder number being blocked. A $25.00 reinstatement fee applies after payments have been collected. All final payments are made directly to the auction company.

j.       Merchandise cannot be taken until the auction concludes, and you have a paid receipt. We provide detailed descriptions of all items to the best of our ability.

k.     Any announcements made on the day of the sale take precedence over all other written, oral, or published statements.

 

2.     Bidding

 

a.     Gobid Auctions Inc. and independent associate auction companies explicitly disclaim any guarantee, warranty, or representation, whether expressed or implied, to bidders regarding any item. This includes aspects such as condition, merchantability, quality, rarity, appraisals, valuations, importance, and fitness for a particular purpose. 

b.     This Site User Agreement establishes a legally binding contract between the bidder and the auctioneer, which remains in effect until terminated by the auctioneer. The auctioneer reserves the right to terminate this agreement at any time, without prior notice, at their sole discretion. If a bidder is dissatisfied with any aspect of the auction sale, their only recourse is to immediately discontinue using the auction site. Additionally, the auctioneer may terminate a bidder’s registration, impose limits on certain features, or restrict access to parts or the entire site without penalty.

c.     The auctioneer reserves the right to set a minimum bid, accept or decline any bids, and withdraw the property before announcing the sale’s completion. Additionally, both the auctioneer and the property owners or employees may bid if desired.

d.     Bidders are prohibited from using any automated tools, such as robots, spiders, or other devices, to monitor or copy the site or its content without our prior written permission. Additionally, bidders must not interfere with the proper functioning of the site or any ongoing activities. Actions that place an unreasonably large load on the auctioneer’s infrastructure are also not allowed. Furthermore, bidders may not copy, alter, modify, create derivative works, or publicly display any content from the site without express written permission. The site is provided “as is,” without any warranties except those legally required and incapable of exclusion or modification.

e.     We recommend that everyone previews the auction they are bidding on. Please be mindful of the specified times, dates, and addresses.

f.      All lots are sold ‘as is, where is,’ without any guarantee of condition or authenticity. While we make every effort to describe items accurately, we highly recommend previewing them.

 

3.     System/Site Responsiveness

 

a.     Our ability to provide continuous, uninterrupted, or secure access to the services is not guaranteed, as various external factors can interfere with site operation. Your internet connection speed will impact how quickly pages with photographs load in your browser.

 

4.     Service

 

a.     The auctioneer is not liable for any service interruptions, errors, or omissions caused by any means. They do not guarantee continuous, uninterrupted, or error-free service or site usage. Bidders acknowledge that this electronic auction relies on hardware and software that may malfunction unexpectedly. In the event of any site malfunction, the auctioneer may void sales, temporarily suspend bidding, or re-sell affected items at their sole discretion. The auctioneer’s decision is final.

 

5.     Compliance with Laws

 

a.     The services may only be used for lawful purposes and in a manner consistent with the law. By using the services, you agree to comply with all applicable laws, statutes, and regulations related to their use and any transactions conducted through them. They are available solely for your personal, noncommercial use, provided that your use is not prohibited by applicable laws and regulations.

 

 

6.     Payment(s)

 

a.     If a bidder has won an item eligible for in-person pickup, they can settle their payment during the designated removal and payment times. Accepted payment methods include cash, Zelle, Visa, and MasterCard. Keep in mind that each auction company may have its own specific payment procedures, so it’s essential to verify this information before placing your bid.

 

 

7.     Payment Non-Compliance

 

a.     Failure to pay for items in accordance with Gobid Auctions, Inc.'s terms, stated pickup dates, or negotiated agreements with independent associate auction companies will result in forfeiture by the bidder. Gobid Auctions, Inc. reserves the right, at its sole discretion, to resell, dispose of, or donate these items to a charity of their choosing. Additionally, Gobid Auctions, Inc. may charge any payment option on file and report the bidder’s account to collections for the combined total of the original invoice amount, storage, moving, or disposal charges. The bidder may be responsible for any costs incurred by Gobid Auctions, Inc. during the collection process.

 

8.     Sales Tax 

 

a.     All sales are subject to the relevant state sales and use tax laws. Tax-exempt buyers must provide the appropriate state sales tax exemption certificate before the sale concludes. Upon acceptance and validation of this information by Gobid Auctions Inc, future purchases by the bidder may remain tax-free if they remain eligible for tax exemption. Bidders may need to periodically update their certificates on file as deemed necessary by Gobid Auctions, Inc.

 

9.     Pick Up/Load

 

a.     Please note that we do not assume responsibility for falls, cuts, bruises, or any injuries. Stay vigilant of your surroundings, particularly during previewing or pickup, and be mindful of your steps.
